New diversity training for bailiffs

Bailiffs and enforcement agents throughout the UK will receive training in diversity before they are allowed to operate under new legislation.

The Tribunals, Courts and Enforcement Bill states that all enforcement agents, including bailiffs, must undergo an extensive programme of training before starting work, including diversity training and guidance about how to handle vulnerable people.

Those breaking the law or operating without a certificate could be fined up to £5,000 or damages and could be barred from continuing in the sector.

The new national framework regulates all enforcement agents who are not employed by the Crown and includes provision for compulsory criminal record checks and certification.

Currently passing through the House of Commons, the new bill will see all debt collectors required to hold a certificate issued by a county court judge and outlines a new code of practice for enforcement agents.

Constitutional affairs minister, Baroness Catherine Ashton, said: "Tens of thousands of people get into debt each year… Not only do they suffer financial and other hardship, but they can often be at the mercy of unscrupulous bailiffs who misunderstand or misrepresent their powers."
